This will give the executors the legal authority to administer the estate of the deceased in accordance with the last will. If a person dies without leaving a will then a grant of administration will be given to the next of kin in a fixed order of priority to distribute the estate according to the laws of intestacy (the law as to who benefits from an estate if no will exists).
Not all estates will require probate, this depends on the total value of your assets. If probate is required and assistance is needed, we can do this on behalf of the executors or administrators and give as much or as little assistance as they require. We charge a fixed hourly rate for the service and can agree a maximum fee before any work is commenced.
We understand that executors may wish to be involved in certain aspects of the administration process, registering the death, distributing the effects from the property and the funeral. We will take over as much or as little as you wish and can assist with simply completing probate application forms if you prefer.
Please be aware that if you are acting as an executor of a will then you are personally liable for any debts or claims against the estate so professional advice is essential.
